Islamic Inheritance Law & Estate Planning

The Qur'anic and Prophetic traditions obligate Muslims to plan for the transition of their wealth upon their death. Prophet Muhammad (S.A.W.) said, "It is not permissible for any Muslim who has something to will, to stay for two nights without having his last will and testament written and kept ready with him." (Bukhari). The Holy Qur'an, in very accurate detail, advises us of who our heirs are and what their shares shall be upon our death. (Surah Al Nisā, 4:11-12, 176). Collectively, the relevant Qur'anic verses and Prophetic narrations comprise what is known as the Islamic Law of Inheritance.

As practicing Muslim attorneys, we specialize in assisting our Muslim clients with navigating the complexities of establishing estate plans consistent with the Islamic Law of Inheritance while residing in the United States. Many Muslim Americans are first-generation converts and may not have family members that will ensure they receive the Islamically permissible end-of-life care and burial services. Some Muslims wish to leave gifts to friends and loved ones who don't qualify as Islamic heirs. While others wish to leave their spouses and children more than they are allotted according to their Qur'anic shares.

These are just a few issues facing indigenous and immigrant Muslim Americans that we help solve by crafting customized solutions. Thus, we are able to assist our Muslims clients in taking advantage of the many secular benefits of comprehensive wealth planning, while also helping them fulfill their religious duties and obligations involving their persons and their wealth during incapacity and upon death.

If you are a Muslim seeking to establish an estate plan which complies with the Islamic Law of Inheritance, contact us today to schedule a free consultation.
